Welcome to CurbVana. These Terms and Conditions ("Terms") govern your use of the CurbVana website (curbvana.com) and services operated by KingdomValor LLC ("CurbVana," "we," "us," or "our"). By accessing our website or booking services through CurbVana, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use our services.

1. Acceptance of Terms

By accessing or using the CurbVana website, mobile applications, or any of our services, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you are using our services on behalf of an organization, you represent that you have the authority to bind that organization to these Terms.

We reserve the right to modify these Terms at any time. Changes will be effective upon posting to our website. Your continued use of our services after any changes constitutes acceptance of the modified Terms.

2. Description of Services

CurbVana operates an on-demand home services booking platform that connects homeowners and property occupants ("Customers") with independent service providers ("Service Providers" or "Subcontractors") for residential home services including, but not limited to:

  • House cleaning
  • Lawn care and maintenance
  • Pressure washing

CurbVana is a technology platform and marketplace. We are not the service provider. All services are performed by independent contractors who have agreed to use our platform. CurbVana facilitates the connection between Customers and Service Providers, processes payments, and provides customer support, but we do not directly employ the individuals who perform the services.

3. Booking and Payment

Booking Process

When you book a service through CurbVana, you are requesting services from an independent Service Provider. By completing a booking, you authorize CurbVana to:

  • Confirm the service appointment
  • Share necessary information with the assigned Service Provider
  • Process payment for the services
  • Send you communications regarding your booking

Payment Terms

All payments are processed securely through Stripe at the time of booking. By providing payment information, you authorize us to charge your payment method for:

  • The total service cost as displayed at checkout
  • Any applicable add-ons or upgrades selected
  • Applicable taxes and fees

Prices are subject to change without notice, but changes will not affect bookings that have already been confirmed and paid.

Receipts and Confirmations

You will receive an email confirmation upon successful booking, including service details, scheduled date and time, and payment receipt.

4. Satisfaction Guarantee

CurbVana stands behind the quality of services provided through our platform with a 100% Satisfaction Guarantee.

If you are not completely satisfied with the services performed:

  1. Contact us within 24 hours of service completion at [email protected]
  2. We will work to make it right — either by scheduling a return visit at no additional cost to address any issues, or
  3. Provide a full refund if we are unable to resolve the issue to your satisfaction

This guarantee applies to the quality of the work performed. It does not cover damage caused by pre-existing conditions, customer-provided equipment or supplies, or circumstances beyond the Service Provider's control.

5. SMS Communications & Messaging Terms

CurbVana SMS Program

Program Name: CurbVana

Program Description: On-demand home services booking and dispatch notifications. By providing your phone number and using our services, you consent to receive automated SMS messages related to your service bookings, including confirmations, reminders, arrival notifications, and completion updates.

Message Frequency: Message frequency varies based on your booking activity. You may receive multiple messages per booking (confirmation, reminder, provider en route, service complete).

Message and data rates may apply. Your carrier's standard messaging rates apply to all SMS messages sent and received.

Opt-Out: Reply STOP to cancel and stop receiving messages from CurbVana.

By providing your phone number during the booking process or account registration, you expressly consent to receive SMS (text) messages from CurbVana. This consent is a condition of using our services.

Types of Messages

You may receive messages including:

  • Booking confirmations and receipts
  • Appointment reminders
  • Service Provider arrival notifications ("Your pro is on the way!")
  • Service status updates
  • Service completion notices
  • Follow-up satisfaction surveys
  • Important account notifications

Opt-Out Instructions

You can cancel the SMS service at any time. Simply text "STOP" to any message you receive from CurbVana. Upon receiving your STOP request, we will send you a single confirmation message to confirm that you have been unsubscribed. After this, you will no longer receive SMS messages from us.

If you wish to rejoin, text "START" to any previous CurbVana message or contact us at [email protected].

Carrier Disclaimer

Message and data rates may apply. Rates depend on your wireless carrier and plan. CurbVana is not responsible for any messaging or data charges incurred. Carriers are not liable for delayed or undelivered messages. Check with your carrier if you have questions about your text messaging plan.

6. Service Provider Relationship

All Service Providers who perform services booked through CurbVana are independent contractors, not employees of CurbVana or KingdomValor LLC. Service Providers:

  • Operate their own independent businesses
  • Set their own schedules and availability
  • Provide their own equipment and supplies (unless otherwise specified)
  • Are responsible for their own taxes, insurance, and business obligations

CurbVana requires all Service Providers to pass background checks, verify references, and maintain appropriate insurance coverage. However, CurbVana does not directly supervise, control, or direct the manner in which Service Providers perform their work.

7. Cancellation Policy

Customer Cancellations

  • More than 24 hours before service: Full refund, no cancellation fee
  • Less than 24 hours before service: A cancellation fee of up to 50% of the service cost may apply to compensate the Service Provider for their reserved time
  • No-shows: If you are not available for a scheduled service without prior notice, the full service amount may be retained

To cancel a booking, please contact us as soon as possible at [email protected] or reply to your booking confirmation message.

CurbVana Cancellations

In rare circumstances, we may need to cancel or reschedule a service due to Service Provider unavailability, weather conditions, or other unforeseen circumstances. If this occurs, we will:

  • Notify you as soon as possible
  • Offer to reschedule at your convenience
  • Provide a full refund if rescheduling is not possible

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW:

CurbVana provides a platform to connect Customers with Service Providers. While we vet our Service Providers through background checks, reference verification, and insurance requirements, CurbVana is not liable for:

  • The actions, omissions, or negligence of Service Providers
  • Any injury, damage, or loss arising from services performed
  • The quality, safety, or legality of services performed
  • Any disputes between Customers and Service Providers
  • Any indirect, incidental, special, consequential, or punitive damages

Our liability is limited to the amount you paid for the specific service giving rise to the claim. This limitation does not apply to liability that cannot be excluded or limited under applicable law.

If you experience property damage or other issues during a service, please contact us immediately at [email protected]. We will work with you and the Service Provider to investigate and resolve the matter.

9. Prohibited Use

You agree not to use CurbVana services or our website for any unlawful purpose or in any way that could damage, disable, or impair our services. Prohibited activities include, but are not limited to:

  • Making fraudulent bookings or providing false information
  • Using stolen or unauthorized payment methods
  • Attempting to circumvent our platform to hire Service Providers directly
  • Harassing, threatening, or abusing Service Providers or CurbVana staff
  • Interfering with the security or functionality of our website
  • Violating any applicable laws or regulations
  • Reselling or commercially exploiting our services without authorization

We reserve the right to refuse service, cancel bookings, and ban users who violate these Terms.

10. Intellectual Property

All content on the CurbVana website, including text, graphics, logos, images, software, and other materials, is the property of KingdomValor LLC or its licensors and is protected by copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, modify, or create derivative works from any content without our prior written consent.

11. Indemnification

You agree to indemnify, defend, and hold harmless CurbVana, KingdomValor LLC, and our officers, directors, employees, agents, and affiliates from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or related to:

  • Your use of our services
  • Your violation of these Terms
  • Your violation of any rights of a third party
  • Any content you provide to us

12. Dispute Resolution

If you have a dispute with CurbVana, we encourage you to contact us first at [email protected] to attempt to resolve the matter informally.

Any dispute, claim, or controversy arising out of or relating to these Terms or your use of CurbVana services that cannot be resolved informally shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association, with arbitration to be held in Hillsborough County, Florida.

You agree to waive any right to a jury trial or to participate in a class action lawsuit against CurbVana.

13. Governing Law

These Terms and any disputes arising from or relating to them shall be governed by and construed in accordance with the laws of the State of Florida, without regard to its conflict of laws principles. You agree to submit to the exclusive jurisdiction of the state and federal courts located in Hillsborough County, Florida for any legal proceedings.

14. Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect. The invalid or unenforceable provision shall be modified to the minimum extent necessary to make it valid and enforceable while preserving the parties' original intent.

15. Entire Agreement

These Terms, together with our Privacy Policy and any other policies or guidelines posted on our website, constitute the entire agreement between you and CurbVana regarding your use of our services and supersede any prior agreements or understandings.

16. Changes to Terms

We reserve the right to update or modify these Terms at any time. Material changes will be indicated by updating the "Effective Date" at the top of this page. We may also notify you of significant changes via email or a prominent notice on our website. Your continued use of our services after changes are posted constitutes acceptance of the modified Terms.
